1. Scope of Services

M.K. Green Planet Gardening and Landscaping Ltd (“the Company”, registration number HE402756) provides professional garden design, landscaping, hardscaping, irrigation installation, pool surrounds, and ongoing garden maintenance services in the Paphos district and wider Cyprus.

The specific scope of work for each project is defined in a written quotation or proposal provided to the client prior to commencement. Any work not explicitly included in the agreed quotation is outside the scope unless separately agreed in writing.

2. Quotations & Pricing

All quotations are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated. Prices are quoted in Euros (€) and include VAT where applicable.

Material costs are based on current supplier prices at the time of quotation. The Company reserves the right to adjust prices if material costs change significantly between quotation acceptance and project commencement, subject to prior client notification.

3. Payment Terms

A deposit of 30% of the total project value is required upon acceptance of the quotation to secure scheduling and commence material procurement. The remaining balance is due upon project completion unless a staged payment schedule has been agreed in writing for larger projects.

For ongoing maintenance contracts, invoices are issued monthly and are due within 14 days of the invoice date.

Late payments may incur interest at a rate of 2% per month on the outstanding amount. The Company reserves the right to suspend services if payment is overdue by more than 30 days.

4. Project Changes

If the client requests changes to the agreed scope of work after the project has commenced, the Company will provide a revised quotation reflecting the additional cost and any impact on the project timeline.

Changes requested by the client must be confirmed in writing (email is acceptable). Verbal instructions for additional work may be carried out at the Company's discretion but will be charged at the applicable day rate.

5. Cancellation Policy

The client may cancel a project at any time by providing written notice. In the event of cancellation:

• If cancellation occurs before work commences, the deposit is refundable minus any costs already incurred for materials ordered or site preparation.
• If cancellation occurs after work has commenced, the client is liable for all work completed to date, materials purchased, and a cancellation fee of 15% of the remaining project value.

The Company reserves the right to cancel or postpone a project due to adverse weather conditions, force majeure, or circumstances beyond its reasonable control, without penalty.

6. Warranty & Liability

The Company provides a 12-month warranty on all hardscaping and construction work from the date of project completion. This warranty covers defects in workmanship and materials supplied by the Company.

Plant material is warranted for 3 months from planting, provided the client follows the care instructions provided. The warranty does not cover plant loss due to neglect, extreme weather events, pest infestation, or interference by third parties.

The Company's total liability for any claim arising from a project shall not exceed the total value of the quotation for that project. The Company is not liable for indirect, consequential, or incidental damages.

7. Intellectual Property

All garden designs, plans, drawings, and digital renders produced by the Company remain the intellectual property of M.K. Green Planet Gardening and Landscaping Ltd until full payment has been received.

Upon full payment, the client receives a licence to use the design for the specific project. The Company retains the right to photograph completed projects and use images for marketing, portfolio display, and social media purposes unless the client explicitly objects in writing.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Paphos, Cyprus.
